With the mandate requiring signed Buyer Representation Agreements beginning in Q3 of 2024, buyers are now obligated to have a signed agreement in place before viewing homes with an agent. What matters most is this: as a Buyer, you should take the time to interview agents carefully. You’re looking for someone who won’t just represent you in a transaction, but who will truly advocate for you—and there is a big difference.
Here are 10 questions to guide your interviews with prospective Buyer’s agents:
1. Do you live in—or have deep knowledge of—the area or subdivision I’m considering?
2. How familiar are you with property values, resale trends, HOA rules, and lifestyle factors in these neighborhoods?
3. How is your commission structured, and who is responsible for paying it on different properties?
4. Do you require a Buyer Representation Agreement, and what are the terms (length, exclusivity, cancellation)?
5. What is your strategy for helping buyers succeed in multiple-offer situations?
6. Have you represented sellers in multiple-offer scenarios, and how does that experience shape your approach for buyers?
7. Can you walk me through the homebuying process in Texas, including timelines, contingencies, earnest money, and the option period?
8. How do you stay in touch with clients during the buying process (text, calls, email), and how quickly do you typically respond?
9. What is your availability for showings, especially if the right home comes on the market with little notice?
10. Do you have a trusted network of local professionals—lenders, inspectors, contractors—that you recommend to your clients?
